I live in Texas and if there is no communication with the father for 6 months you can have his rights terminated. However, you must have someone else who is willing to adopt the child. I know this because I am going though this with my 9 yr old son. Also, my attorney told me if he pays child support it is considereed communication. As of December 8th we will be able to terminate my ex's rights and my husband can adopt him. he hasn't seend my son since October 10, 2005 but he paid child support until June 8 of this year.
There really isn't one. You need to just petition the court for sole legal custody. If he isn't there to contest it's not an issue.
