Depending on which State you live in, but yes the mother can put the baby in her name. Some States require that once the father signs the birth certificate than the baby receives the father's name if you two aren't married. If you are married the child must go with the husbands last name.

List the father un known. Now if she is married & useing Maiden sir name and living in the state of Washington, the child is given the sir name of the father. Now if she devorices him prior to the birth and she dos or dose not list her Exhusdand on the birth certificate the child is given the fathers last name.
