In the state of Virginia, how old does a child have to be to decide which parent they want to live with?

The child is between four and six and comes to stay with one parent every weekend and all of the childs free time, well when it is time for the child to back with the parent with whom has the child on school nights, or when its time to go back at all, the child cries and refuses.

Answer:
Let the court in Virginia be in charge of that. There's some research that YOU need to do, we have no clue as to what the rules are in Virginia unless we research it ourselves.

the child never has a say. the courts decide which parent is fit. which parent can provide a stable living environment . not the child. a lot of factors go into it.a child's want is considered but it ultimately doesn't really count sorry
I don't know about your state. But in my state it is not till age 12. At age 12, they can tell the judge where they want to go, but that doesn't mean that it will happen. It is however taken into consideration.
I dont know what the first responder is talking about. 12 or 13 is when the child can choose. Unless the court sees the parent as unfit the child can choose.
