Anyone can petetition for a name change. Even an adoptive parent must get the name change done as a separate petition of the court. In that case a new birth certificate is issued and the old one sealed as a third petition to the court.

In your case, talk to a lawyer and determine if you have grounds to petition a court for a name change withour adoption. It would seem difficult to me.
