What is she doing that she is so horrible? If she is wants give him up for any number of reasons then of course it would be easier..but to just say - cuz she is horrible- wont fly anywhere unless there is proof. Gather evidence, and then Social services and the courts will decide.
I adopted my nephew, because my brother gave me him. I almost was not able to do that - took 7 yrs for it to be finalized. The website at that I used and helped me is included.

Without both parents legally relinquishing their parental rights, you cannot adopt him. Sorry.
I would get a lawyer, and talk with him. and he can do all the legal paper work for you. but be prepare for a fight on your hands, because if your sister don't agree to it. look out.
if its that bad then maybe you should call CPS
