My son was taken last month for failure to thrive. What are my Legal rights? Any suggestions would be great.?
Answer:
YOu need to find a lawyer. Honestly, my baby was almost hospitalized for the same thing. YOU made the appointment, it's not like someone else noticed it and called. He may have GERD that makes him throw up. My 2nd child has had it since birth and was very small as a baby. I will pray for you and your baby. I'm so sorry.
Was he taken today?
Call the child protective services and make an appointment to speak with the case worker assigned to your son. When you meet, ask for information as to when and where the case will be heard(there is usually a court case involved). Also, depending on the person you speak with, ask what you need to do to get him back and explain the situation. It will be hard, but the big thing is to remain calm and not end up screaming at someone there. After that, it would be time to get a lawyer and see what happens.
That would really be a great question for a lawyer!
I can't believe that he was taken just because he spits up & refuses food. Not pointing fingers or making accusations, but is there more to this story?
I find it interesting that your son was taken and you calmly come on a site like this to inquire about your options. As if anyone here can do anything for you. They took your child! Shouldn't you be contacting a lawyer and trying to get him back rather than playing on the internet? I agree, there is much more to this story. No one would just take your child for not keeping food down or spitting up too much. They'd first work WITH you and possibly have you take classes. They'd assign you a worker who would check in on you and make sure things were getting better. I used to work with young, teen moms. They were always given a chance to be educated before anyone would just step in and take their kids. Plus, they'd need much more evidence that the mom was the cause for failure to thrive. Yep, much more to this story.
what has your doctor been doing for nine months my daughter is listed as a failure to thrive at her 1 month check up when i felt she wasn't gaining and right away i had her to specialists and new fomula and everything she just finally started to gain weight they probally took your child becasue you waited to long to do anything and the first reason they always suspect for falure to thrive is the parent isn't feeding the child so i would get a lawyer and have your document all the visits and why nothing was done before hand...
